Nutshell69, you and UncleRob are talking about 2 different things. I have alot of wallpapers dl'd form different sites that cost nothing to obtain. If I were to base a skin on on of these, it's not copyright infringement. Looking at a picture of Spidey and deciding you want to base a skin on that is completely legal.

However, if I were to post someone else's work on this (or any other) site and claim credit, then I would be in violation of the copyright laws.

You guys have misconstrued the meaning of fan art. If you didn't make it from scratch, it's not fan art. It's violating someones legal rights. No grey area here. It is black and white.

A lot of work is copyright protected as soon as it is posted to many sites, weather you can download it for free or not. So, it would be copyright infringement. With the whole 'Spidey' thing, you are walking a fine line between fan art, fair use, and again, weather you like it or not, copyright infringement.

Even folks at DA who produce and post their own stock images for others to use, alter, and manipulate to their own ends can set the rules on it's use because it is copyright protected.

The work mentioned early in the thread was copyright protected, it was just a matter of someone not looking for the copyright statement.

You know Alperium I find it ironic that you get so upset when someone ' ripped ' your work.

Do you recall just a short time ago a logon you uploaded that appeared in the ' newest' gallery and it was pointed out to you by someone that they had this particular wallpaper for over 4 years and they saw no mention of the original author in your description nor any permission included. Within seconds you deleted the logon.

You then asked this person if they knew who the author was because you had been unable to find them.

Not a valid excuse from someone that had uploaded as much as you have.

I'll refresh your memory - the wall was a bunch of soldiers with gas masks on.

The discussion has provided me a lot of information about a really complex matter. The two things which really confuse me are....

1)If I see a wall of celebrity or a landscape and I submit a boot, logon or wallpaper on it then will it be valid, what if I modify it myself and again submit it?

2)If someone has created a dxwidget through scripting by own and I separately do the same job to do the same function and submit it as a widget, then will my widget get accepted?

I have found this picture in a network without the indication of the author.
When to me have said that my job breaks the copyright - I have removed it and did not wait while It will remove by moderators.
In this case to this person at once have written that he not the rights, but he waited while his job will remove by moders.

I think he's learning, as we all are, no matter how long we've been here. Considering he had several works removed over 8 months ago and didn't hide or disappear over it, says a lot. He's faced the critics and the mods and has worked hard to be a good contributor to the skinning community...and a contributor in good standing. I think that was reflected in his promotion. Ironic or not (not even sure 'ironic' defines this), he was still ripped.

And my point was ... this was not long ago. The wall I was referring to was at a local wallpaper site. You just do not take someone else's work and upload it as a logon.

Someone ripped his work ...he didnt like it. Maybe he sees my point now.

I think he saw your point and everyone else's...which is why he has become a valued member of the community over the past months since all this happened. I don't understand the need to rehash it or the 'how do you like it' tone. Will this be how we respond from now on if he gets ripped?
